Welcome to MyDocUSA (the “Site”). These Terms & Conditions (“Terms”) govern your access to and use of the Site and any services (including payment/merchant services) provided through or related to the Site. By using or accessing the Site, or by completing a transaction, you agree to these Terms. If you do not agree to all of them, you must not use the Site or transact.

 

1. Definitions

  • “We,” “us,” and “our” refer to MyDocUSA , the operator of this Site.

  • “You,” “your,” or “customer” means any individual or entity using the Site, purchasing goods or services, or otherwise interacting with our services.

  • “Services” includes any payment processing, merchant account facilitation, order fulfillment, or other offerings we provide via the Site.

  • “Transaction” means a purchase, order, payment, or other exchange of value via our Site or services.

 

2. Eligibility & Account Creation

  • You represent and warrant that you are at least the age of legal majority in your jurisdiction, and have full power and authority to use the Site.

  • To access certain features, you may be required to create an account. You agree to provide true, accurate, current, and complete information. You are responsible for maintaining the security of your account credentials.

  • You agree that you will not impersonate another person, create false identities, or otherwise misrepresent your identity.

 

3. Use of Site & Acceptable Conduct

  • You may use the Site only for lawful purposes and in accordance with these Terms.

  • You will not use the Site to transmit any harmful or malicious code (e.g. viruses, malware), spam, or violate any applicable laws or regulations.

  • You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site without our prior written permission.

  • We reserve the right to suspend, restrict, or terminate your access to all or part of the Site at any time, for any reason, without notice.

 

4. Payment, Processing & Merchant Services

  • If you transact through our Services, you agree to pay the relevant fees, charges, processing costs, and any applicable taxes.

  • All payment processing is subject to the rules and requirements of applicable card networks (Visa, MasterCard, American Express, etc.) and banking partners.

  • You authorize us to initiate debits and credits to your designated account as necessary for payments, refunds, and chargebacks.

  • We may impose holds, reserves, or delays on settlement of funds in accordance with card network rules or risk management.

  • You must comply with PCI-DSS and all security standards required by card networks, and you are responsible for handling cardholder data securely.

 

5. Refunds, Cancellations & Returns

This section must reflect your actual policy. Below is a sample which you should adjust:

  • Refund Policy: If you are not satisfied with a purchased product or service, you may request a refund within 7 days from the date of purchase, provided the product is returned in its original condition and packaging (if applicable). Shipping/handling costs are non-refundable.

  • Cancellation: You may cancel an order within 12 hours of placing it. After that, cancellation is subject to our discretion and possible restocking or cancellation fees.

  • Returns / Exchanges: Any returned items must be unused, in original packaging, with proof of purchase. Return shipping costs may be borne by the customer. Exchanges are subject to availability.

  • Exceptions: Certain products/services (e.g. digital goods, custom-made items) are non-refundable. These exceptions will be clearly stated on the product page.

You agree to display your refund/cancellation policy conspicuously (as required by START) so that customers can review it before completing a purchase. (Start Merchant Services)

 

6. Shipping & Delivery

  • We will process orders in a timely manner upon payment confirmation.

  • Estimated delivery times are provided as approximations and are not guaranteed.

  • You are responsible for providing accurate shipping address and relevant information.

  • Risk of loss or damage passes to you once the item is shipped (unless local law dictates otherwise).

 

7. Intellectual Property & Licenses

  • All content on the Site (text, graphics, logos, images, software) is the intellectual property of us or our licensors, and is protected by copyright, trademark, and other laws.

  • You are granted a limited, non-exclusive, revocable license to access and use the Site for personal, non-commercial purposes only.

  • You may not copy, modify, distribute, transmit, display, perform, reproduce, license, create derivative works from, or otherwise exploit any content on the Site without our express written permission.

 

8. Limitation of Liability & Disclaimers

  • The Site and Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied.

  • To the maximum extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

  • We do not warrant that the Site will be uninterrupted, error-free, secure, or free from viruses.

  • In no event shall we (or our officers, directors, employees, agents) be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use or inability to use the Site or Services, even if advised of the possibility of such damages.

  • Our aggregate liability to you for any claim arising in connection with these Terms will not exceed the total fees actually paid by you to us during the twelve (12) months prior to the event giving rise to the claim.

 

9. Indemnification

You agree to defend, indemnify, and hold us and our officers, directors, employees, agents, and affiliates harmless from and against any claims, demands, liabilities, losses, damages, costs, or expenses (including reasonable attorneys’ fees) arising from or relating to:

  • your use of the Site or Services,

  • your breach of these Terms,

  • your violation of any law or the rights of any third party,

  • any content you post or transmit through the Site.

 

10. Termination

  • We may terminate or suspend your access, in whole or in part, at any time, for any or no reason, without notice.

  • Upon termination, you must cease all use of the Site and Services. Provisions which by their nature should survive (e.g. indemnification, limitation of liability, intellectual property, refund obligations) will survive.

 

11. Governing Law & Dispute Resolution

  • These Terms shall be governed by and construed in accordance with the laws of USA

  • You agree that any dispute, claim, or controversy arising from or relating to these Terms or your use of the Site shall first be submitted to good faith negotiation. If not resolved, disputes may be resolved by arbitration or in courts in the designated jurisdiction (as you choose).

  • You waive any right to a jury trial (if allowed under local law) and agree that any arbitration shall be individual (i.e. no class arbitration or consolidated claims).

 

12. Changes to Terms

We reserve the right to update, amend, or replace any part of these Terms at our discretion by posting updated Terms on the Site. It is your responsibility to check this page periodically for changes. Your continued use of the Site following the posting of changes constitutes acceptance of those changes.

 

13. Miscellaneous

  • Severability: If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, that provision shall be struck and the remaining provisions shall remain in full force and effect.

  • Waiver: No waiver by us of any term or condition will be deemed a further waiver of that term or any other term, and our failure to enforce any right or provision will not constitute a waiver of such right or provision.

  • Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may freely assign these Terms without restriction.

  • Notices: We may provide notices via email, by posting on the Site, or by other reasonable methods.

  • Entire Agreement: These Terms (along with any documents expressly incorporated by reference) constitute the entire agreement between you and us concerning the Site and Services, superseding any prior agreements.
